NOTICE OF SALE To the above named Defendants and all others interested: NOTICE IS HEREBY GIVEN that on October 14, 2008 at 9:15 a.m., the undersigned Special Master will, a the main entrance of the Bernalillo County Courthouse, 400 Lomas Boulevard NW, Albuquerque, New Mexico 87102, sell all right, title and interest of the abovenamed Defendants in and to the hereinafter described real estate to the highest bidder for cash. The property to be sold is located at 3707 Comanche Road NE, Albuquerque, New Mexico 87110, and it is particularly described as follows: LOT NUMBERED FIVE (5) IN BLOCK NUMBERED TWO (2) OF CARLISLE PLAZA, AN ADDITION TO THE CITY OF ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE MAP OF SAID ADDITION FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON OCTOBER 30, 1951, IN PLAT BOOK D1, FOLIO 28. THE FOREGOING SALE will be made to satisfy a judgment rendered by the above Court in the above-entitled and numbered cause on March 5, 2008, being an action to foreclose two mortgages on the above-described property. The Plaintiff Jim Siebenthal Property Management LLC's Judgment on Count I in this matter is in the amount of $29,454.20 and the same bears interest at the rate of nine and one-half percent (9.5%) per annum from March 6, 2008, to the date of sale. The Plaintiffs James Siebenthal and Eileen Siebenthal's Judgment on Count II in this matter is in the amount of $11,063.34 and the same bears interest at the rate of sixteen percent (16.00%) per annum from March 6, 2008, to the date of sale. The amount of such interest on Count I to the date of sale is $1,701.89 and the amount of interest on Count II to the date of sale is $1,076.62. In addition thereto, Plaintiff Jim Siebenthal Property Management, LLC has advanced the sum of $27,227.48 to the first Mortgage holder Deutsche Bank to protect the position of the two Mortgages being foreclosed herein. The total of the two Judgments, interest to date of sale, and property protection expenses is $70,523.53. The sale of he above-described property is subject to the prior mortgage of Deutsche Bank National Trust Company, as Trustee, and to any patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the abovedescribed real property subject to a one (1) month right of redemption. The Plaintiffs may apply all or any part of their Judgments to the purchase price in lieu of cash. The sale may be postponed and rescheduled at the discretion of the Special Master. |
