NOTICE OF HEARING BY
PUBLICATION THE STATE OF NEW MEXICO: TO: UNKNOWN HEIRS OF LEONIDES T. LINAM, DECEASED, AND ALL UNKNOWN PERSONS WHO HAVE OR CLAIM ANY INTEREST N THE ESTATE OF LEONIDES T. LINAM, DECEASED, OR IN THE MATTER BEING LITIGATED IN THE HEREINAFTER MENTIONED HEARING. Hearing on the petition filed by the undersigned personal representative, which petition provides: 1. Applicant, Marvin Linam, is the son of the decedent and is, therefore, a person interested in the settlement of the estate of decedent, is not disqualified to serve as personal representative, and there are no other persons having a prior right to the appointment. 2. Leonides T. Linam died on November 22, 1998, at the age of 76 years. At death, decedent was domiciled in Albuquerque, Bernalillo County, New Mexico thus giving rise to venue. 3. The decedent died testate. The original Last Will and Testament of decedent cannot be located. However, a true copy of the Last Will and Testament and supporting affidavit are filed with the Second Judicial District Court, Albuquerque, Bernalillo County New Mexico. 4. Applicant has not received and is not aware of any demand for notice of any probate or appointment proceeding concerning the decedent filed in New Mexico or elsewhere. 5. Pursuant to Section 45-3-108 (NMSA)(4) 1978, an informal appointment proceeding may be commenced in order to transfer title to assets to the successor of the estate. Hearing will be held at The Honorable Geraldine E. Rivera's Courtroom at 400 Lomas Avenue NW, Albuquerque, NM 87103 on Thursday, June 11, 2009, at 9:10 A.M. Pursuant to 41-1-401 NMSA 1978, notice of the time and place of hearing on said petition is hereby given you by publication, once each week, for two consecutive weeks.
