NOTICE OF SALE ON
FORECLOSURE
PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property situated in Bernalillo County, New Mexico, commonly known as 1836 Britt Street NE, Albuquerque, New Mexico 87112, and more particularly described as follows: Lot numbered Three (3) in Block Numbered One Hundred Eighteen (118) of SNOW HEIGHTS as the same is shown and designated on the plat of said subdivision of Blocks Eighty-Eight-B (88B) through One Hundred Twenty-Nine (129) filed in the office of the County Clerk of Bernalillo County, New Mexico, on December 31, 1953. (hereinafter the “Property”). The sale is to begin at 10:00 a.m. on February 19, 2010 outside the front entrance of the Bernalillo County District Court, 400 Lomas NW, Albuquerque, New Mexico 87102, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America the Property to pay any expenses of sale, and to satisfy the Judgment granted Plaintiff on January 20, 2010 in the principal sum of $145,900.00, plus outstanding interest due on the Note in the amount of $4,753.65 as of September 30, 2009, and accruing thereafter at the rate of 7.3750% per annum or $29.48 per day, plus late charges of $134.49, plus title report fee of $267.19, less escrow credit balance of $278.36, plus document preparation charge of $50.00, plus attorney’s fees and costs incurred in connection with this foreclosure action of $2,500.00, plus court costs of $205.73, plus special master’s fees and all other costs of foreclosure sale. The judgment shall accrue interest at the rate of 7.3750% per annum until paid. The sale is subject to a one (1) month right of redemption in favor of Defendant Ernest J. Lucero and as specified in the Judgment filed herein. |
