NOTICE OF SALE
NOTICE is hereby given that on Friday, March 5, 2010, at 10:00 a.m., the undersigned Special Master will sell to the highest bidder at the Second Judicial District Courthouse, 400 Lomas Blvd. NW, Albuquerque, NM 87102, all Defendants’ interest in the real property located at 2015 Menaul Blvd. NE, Albuquerque, Bernalillo County, New Mexico 87107, and more particularly described as: “PARCEL 2” MENAUL DEVELOPMENT AREA, ALBUQUERQUE,NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID SUBDIVISION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON AUGUST 2, 1984, IN MAP BOOK C24, FOLIO 146. TOGETHER WITH ALL RIGHTS, EASEMENTS, APPURTENANCES, ROYALTIES, MINERAL RIGHTS, OIL AND GAS RIGHTS, ALL WATER AND RIPARIAN RIGHTS, DITCHES, AND WATER STOCK AND ALL EXISTING AND FUTURE IMPROVEMENTS, STRUCTURES, FIXTURES, AND REPLACEMENTS THAT MAY NOW, OR AT ANY TIME IN THE FUTURE, BE PART OF THE REAL ESTATE DESCRIBED ABOVE. THIS SECURITY INSTRUMENT IS GIVEN UPON THE STATUTORY MORTGAGE CONDITION. The sale will satisfy all or a portion of the Default Judgment Against Defendants Elim Investments, LLC, Willy Wonje Choi, a/k/a Willie Wonje Choi, and Chin Bong Lee, a/k/a Christopher Lee; Decree of Foreclosure; Order of Sale; and Appointment of Special Master; and Stipulation of Foreclosure (“Judgment”) entered on January 27, 2010, as follows: A. Judgment against Defendants Elim Investments, LLC, Willy Wonje Choi, a/k/a Willie Wonje Choi, and Chin Bong Lee, a/ k/a Christopher Lee, jointly and severally, in the amount of $1,660,511.72, plus its costs of $491.41 and attorney’s fees and tax of $5,258.25, for a total judgment of $1,666,261.38, with interest continuing to accrue at 6% per year from August 3, 2009. B. Plaintiff shall have judgment against Defendants Elim Investments, LLC, Willy Wonje Choi, a/k/a Willie Wonje Choi, and Chin Bong Lee, a/k/a Christopher Lee, jointly, removing all their interest in the subject property. C. Defendant United States Small Business Administration holds a valid second lien on the real property and personal property and may, as provided by 28 U.S.C. ‘ 2410, credit bid the amount of its lien at the foreclosure sale as the equivalent of cash after payment of Plaintiff’s judgment amount. The Judgment may be obtained from either the court clerk or the undersigned Special Master prior to the sale date. Western Commerce Bank has the right to bid at the sale and to apply its judgment or a portion thereof to the purchase price in lieu of cash. For all other bidders, the sale terms are cash or its equivalent by the close of business on the day of sale. The sale may be postponed and rescheduled at the Special Master’s discretion. |
