NOTICE OF SALE
NOTICE IS HEREBY GIVEN that the undersigned Special Master will, on the 24th day of February, 2010, at 10:00 A.M. on the front steps of the Bernalillo County Courthouse, in Albuquerque, New Mexico, sell and convey all the right, title and interest of the above-named Defendant in and to the real property located in Bernalillo County, New Mexico, and further described, to wit: 2500 Morris, N.E., Albuquerque, New Mexico 87112 and further described to wit: LOT NUMBERED TWENTY (20) IN BLOCK NUMBERED SIXTYSIX (66) OF SNOW HEIGHTS, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF BLOCKS 43 TO 88 INCLUSIVE OF SAID ADDITION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON NOVEMBER 4, 1953, IN PLAT BOOK D1 FOLIO 104. This sale is made pursuant to an Order of Default Judgment and Decree of Foreclosure of Mortgage entered in the aboveentitled cause of action on January 22, 2010 (Judgment), in order to foreclose and satisfy said Judgment and any and all liens and encumbrances said realty may be subject to, and in the proper priority of same as set forth in said Judgment. The Judgment for the Plaintiff COLORADO STATE BANK AND TRUST, in the above-entitled and captioned action was entered on or about January 22, 2010, in the approximate amount of $131,897.45, plus post Judgment interest on said Judgment from December 9, 2009 to date of foreclosure sale at the Judgment rate of 8.75% per annum in the amount of $2,434.68, plus costs of sale and notice of publication costs incurred herein. Said sale shall be completed to the highest and best bidder for cash and the Plaintiff shall be allowed to bid all or part of its judgment and said Judgment shall be applied to the purchase price. “Cash” for the purposes of this sale shall mean cash or other immediately available funds. Said sale shall be subject to property taxes, easements and restrictions and covenants of record and liens not foreclosed in the aforesaid judgment and rights of redemption of the Defendant, if any. The Special Master shall have all rights and powers pursuant to the laws of the State of New Mexico, including the power to postpone said sale in his discretion. |
