NOTICE OF HEARING BY

PUBLICATION THE STATE OF NEW MEXICO: TO: Unknown heirs of John J. Montoya, Deceased, and all unknown persons who have or claim any interest in the Estate of John J. Montoya, Deceased, in the matter being litigated in the hereinafter mentioned hearing. Hearing on the Application filed by the undersigned Personal Representative, which Application provided:
Cynthia M. Cordova states:
1. Applicant is the daughter of Decedent, and is, therefore, a person of interest in the settlement of the Estate of Decedent, is not disqualified to serve as personal representative, and there is no other person having a prior right to the appointment. 2. John J. Montoya died on January 25, 2010, at the age of 72. At death Decedent was domiciled in Albuquerque, Bernalillo County, New Mexico, thus giving rise to venue. The names and addresses of the children and heirs of the Decedent, so far as known or ascertainable with reasonable diligence by the applicant are:

The Decedent died intestate and left no devisees. 3. No personal representative of the Decedent has been appointed in New Mexico or elsewhere. 4. Applicant has not received and is not aware of any demand for notice of any probate or appointing proceeding concerning the Decedent filed in New Mexico or elsewhere. 5. The time for formal appointment proceedings has not expired because three years or less have passed since Decedent’s death. 6. After the exercise of reasonable diligence, Applicant is unaware of any unrevoked testamentary instrument relating to property having a situs in New Mexico under the laws of New Mexico. 7. Applicant requests an Order to determine the heirs of the Decedent. WHEREFORE, Applicant prays that the Court fix a time and place of hearing; notice be given to all interested persons as provided by the laws of New Mexico; after notice and hearing, the Court enter its Order determining the heirs of Decedent; for appointment as Personal Representative of the Estate, without bond, in an unsupervised administration; that Letters of Administration be issued to Applicant, and for such other and further relief as may be proper. will be held at the Bernalillo County District Courthouse on April 7, 2010, at 8:45 a.m. Pursuant to §45-1-104, N.M.S.A. 1978, notice of the time and place of hearing on said Petition is hereby given you by publication, for two consecutive weeks.
