NOTICE OF SALE ON

FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the “Property”) situated in Bernalillo County, New Mexico, commonly known as 2532 Cutler Court NE, Albuquerque, New Mexico 87106, and more particularly described as follows: A portion of Lots numbered Eight (8) and Nine (9) in Block lettered E-I, a Replat of a portion of Netherwood Corporation’s Replat of NETHER WOOD PARK, an Addition to the City of Albuquerque, New Mexico, as the same is shown and designated on the Replat of said Addition, filed in the office of the County Clerk of Bernalillo County, New Mexico, on June 21, 1957 in Plat Book D2, folio 42, and more particularly described as follows: BEGINNING at the front lot corner common to Lots 9 and 10, thence N. 84 deg. 05’ E., a distance of 76.32 feet; thence S. 58 deg. 00’ E., a distance of 147.77 feet; thence, S. 50 deg. 58’ W., a distance of 92.00 feet; thence N. 70 deg. 24’ W., a distance of 130.9 feet; thence northerly on a curve with a radius of 50.00 feet for an arc distance of 14.38 feet; thence, N. 05 deg. 55’ W, a distance of 70.62 feet to the point of beginning. Excluding therefrom two pieces of property sold from the property described above which are described as follows: A triangular tract of land, being a portion of Lots 8 and 9, Block E-I, Netherwood Park, as the same is shown and designated on the Second Replat of a portion of Netherwood Park, an Addition to the City of Albuquerque, New Mexico, as the same is shown and designated on the plat thereof; filed June 21, 1957, and more particularly described as follows: BEGINNING at the East corner of the tract herein described, which point lies S. 50 deg. 58’ W., 2.10 feet from the northeast corner of said Lot 8, and from said beginning point running thence, S. 50 deg., II’ E., 29.29 feet to the place of beginning. A plot of land in Block E-I of Second Replat of a Portion of Netherwood Park, an Addition to the City of Albuquerque, Bernalillo County, New Mexico, as the same is shown and designated on the plat of said addition filed in the office of the County Clerk of Bernalillo County, New Mexico on June 21, 1957, consisting of portions of Lots 8 and 9 of said Block E-I and being more particularly described as follows: BEGINNING at the Northeast corner of the herein described tract, a point that is coincident with the southeast corner of Lot 12, Block E-I of said Netherwood Park Addition; thence S. 50 deg. 28’ W., 51.69 feet to the Southeast corner; thence N. 58 deg. 00’ W., 29.29 feet to the southwest corner; thence N. 5 deg. 53’ W., 61.97 feet to the Northwest corner; thence S. 58 deg. 56’ E., 84.17 feet to the place of beginning. The sale is to begin at 11:10 a.m. on March 16, 2010, on the front steps of the Second Judicial District Courthouse, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Aurora Loan Services, LLC. Aurora Loan Services, LLC was awarded a Judgment on November 1, 2009, in the principal sum of $336,060.77, plus outstanding interest on the balance through September 15, 2009, in the amount of S15,669.41, plus late charges of $179.64, plus recoverable/ escrow balance in the amount of $3,891.51, plus attorneys fees in the sum of $900.00 and costs through September 15, 2009 in the sum of $458.60, with interest on the Judgment including late charges, property preservation fees, escrow advances, attorney’s fees and costs of this suit at the rate of 7.50% per annum from date of the entry of the Judgment until paid. NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Aurora Loan Services, LLC and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any. NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one (1) month right of redemption. PROSPECTIVE PURCHASERS AT SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE TITLE AND THE CONDITION OF THE PROPERTY AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.
